By accessing or using InstantLoans.ai, you agree to be bound by these Terms of Service. If you do not agree, please do not use our services.
2. Description of Service
InstantLoans.ai acts as a marketplace/aggregator connecting prospective borrowers with participating lenders and lending partners. We are not a lender and do not make credit decisions.
3. User Responsibilities
You agree to provide accurate, current, and complete information during the pre-qualification process. You must be at least 18 years old and a legal resident of the United States to use this service.
4. Limitation of Liability
InstantLoans.ai is not responsible for the actions or inactions of any lender. Any loan agreement you enter into is solely between you and the lending partner. We shall not be liable for any damages arising from your use of the service or your reliance on the information provided.
5. Dispute Resolution and Binding Arbitration
PLEASE READ THIS SECTION CAREFULLY AS IT AFFECTS YOUR LEGAL RIGHTS AND REQUIRES YOU TO RESOLVE DISPUTES WITH US ON AN INDIVIDUAL BASIS THROUGH FINAL AND BINDING ARBITRATION.
Any dispute, claim, or controversy arising out of or relating to these Terms of Service, the use of the InstantLoans.ai platform, or the breach, termination, enforcement, interpretation, or validity thereof, including the determination of the scope or applicability of this agreement to arbitrate, shall be determined by arbitration in Wyoming before one arbitrator. The arbitration shall be administered by JAMS pursuant to its Comprehensive Arbitration Rules and Procedures. Judgment on the Award may be entered in any court having jurisdiction.
6. Class Action Waiver
YOU AND INSTANTLOANS.AI AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING.
Further, unless both you and InstantLoans.ai agree otherwise, the arbitrator may not consolidate more than one person's claims with your claims, and may not otherwise preside over any form of a representative or class proceeding. The arbitrator may award declaratory or injunctive relief only in favor of the individual party seeking relief and only to the extent necessary to provide relief warranted by that party's individual claim.
7. Electronic Signature Consent (E-SIGN Act)
By clicking "Continue", "Submit", or any similar button on our platform, you agree to the use of electronic signatures and records as a legally binding method of contract execution under the Electronic Signatures in Global and National Commerce Act (E-SIGN Act). You consent to receive all disclosures, notices, and communications electronically.
